Dzie\u0144 ten zosta\u0142 ustanowiony \u015bwi\u0119tem na mocy ustawy sejmowej z 23 kwietnia 1937 r., podpisanej przez prezydenta Ignacego Mo\u015bcickiego. W czasie II wojny \u015bwiatowej obchodzenie tego \u015bwi\u0119ta by\u0142o niemo\u017cliwe. W 1945 roku, po zako\u0144czeniu wojny, polskie w\u0142adze komunistyczne ustanowi\u0142y \u015bwi\u0119tem narodowym 22 lipca, czyli dzie\u0144 podpisania Manifestu PKWN. W czasach PRL obchody \u015awi\u0119ta Niepodleg\u0142o\u015bci by\u0142y zakazane.
